Understanding Your Documents

Last Will and Testament

Your Will sets out how you want your assets distributed after you pass away, who you want to manage your estate, and who should care for any minor children. Without a valid Will, Ontario's intestacy laws determine what happens to your estate, which may not reflect your wishes.

Power of Attorney for Property

A Power of Attorney for Property designates someone you trust to make financial and legal decisions on your behalf if you are unable to do so. This can be essential in situations involving illness, injury, or absence.

Power of Attorney for Personal Care

A Power of Attorney for Personal Care designates someone to make decisions about your health care and personal well-being if you are ever unable to communicate your wishes. It ensures the people who matter to you know what you want.

  • Your documents are properly executed and legally valid

Our Pricing

Dwell Law offers transparent, flat-fee pricing for wills and powers of attorney.

What you pay Dwell Law:

  • Individual package: $1,000 + HST

  • Couple package: $1,800 + HST

Both packages include a Last Will and Testament, Power of Attorney for Property, and Power of Attorney for Personal Care. For couples, all documents are prepared for both people.

Additional fees may apply depending on the complexity of your situation. We will confirm at your consultation and provide a clear written quote before any additional work proceeds.

As part of our commitment to security and compliance, Dwell Law requires electronic ID verification for all signatories. Our current provider rate is $27.50 + HST per person.

What happens if I die without a Will in Ontario?

If you die without a valid will in Ontario your estate is distributed according to the Succession Law Reform Act, which may not reflect your wishes. Your spouse, children, and other relatives receive shares determined by legislation rather than by you. Having a valid will ensures your wishes are followed.

Do I need a lawyer to make a Will in Ontario?

You are not legally required to use a lawyer but a lawyer-prepared Will is far less likely to contain errors or ambiguities that could cause problems for your estate. DIY Will kits are legally valid only if executed perfectly, and errors in execution can invalidate the entire document.

What is the difference between a Power of Attorney for Property and a Power of Attorney for Personal Care?

A Power of Attorney for Property covers financial and legal decisions. A Power of Attorney for Personal Care covers health care and personal well-being decisions. Both are important and work together to ensure your wishes are respected if you are ever unable to make decisions for yourself.

Can I update my Will after it is made?

Yes. Your will can be updated at any time through a codicil or by creating a new Will. Major life changes such as marriage, separation, the birth of a child, or the death of a beneficiary are common triggers for updating estate documents.

Why does final signing have to be in person?

Ontario law requires that Wills and Powers of Attorney be signed in person with a witness present. Electronic signing is not currently permitted for these documents. Dwell Law provides the witness at your signing appointment so there is nothing you need to arrange yourself.

Can both people in a couple sign at the same appointment?

Yes. For couples we coordinate a single signing appointment where both people can complete their documents together, making the process as convenient as possible.
